無實體數位資訊適用消保法無條件解除權之研究

摘要


本文總共分為五章,第一章緒論闡明論文之動機、目的、範圍與方法和架構,預期將問題意識提出。接續第二章,本文試著介紹無實體數位化資訊之定義、內涵與特性來瞭解其獨特性並就其交易客體及法律性質來知悉何謂無實體數位化資訊交易,接著闡述我國近年法院及行政機關對Google有關APP之交易針對適用消保法中有關郵購買賣的案例評析,並衍生提出有關案例之問題,檢視我國消保法郵購買賣之規定及對無實體數位化資訊APP應用程式適用消保法所產生之疑義;以及此規定對行動商務無實體數位化資訊發展可能帶來的影響。緊扣著第三章,就我國消保法郵購買賣相關規定,有第2條第10款規定,以及同法第19條並同條第1項來做進一步法條分析,然而郵購買賣與所謂的無實體數位化資訊交易兩者之間仍有相當程度之差異,如交易客體、契約類型、交易客體是否可事前檢視、交易方式等等…,以及探討我國此現行法律架構下,適用於無實體數位化資訊交易環境之扞格處,相較其特色與傳統交易模式之主要差異處為何。 因網際網路係全球性的整合特質,故第四章將先對於國際上針對電子商務無實體數位化資訊的法制建設架構及立法趨勢做一介紹,並且列舉歐盟、美、日本等國外立法例,分析討論各國之相關法制為適度保障消費者權益與衡平企業經營者間的利益,而給予消費者、客體之間不同且特定程度的保護或對於契約解除權加以限制等例外規定,在第五章則接續上章參閱外國法現行的無實體數位化資訊之實務交易後,將郵購買賣涵蓋其各種商品及羅列的交易類型中的不足之處,試以案例、外國立法例及國內專家學者意見來還檢討現行消保法有關郵購買賣對無實體數位化資訊交易之立法妥適性,來尋求是否有待修法或者重新立法的需要,最後提出本文之建議,以供參考以求配合實務上來運作且同時冀希提升我國消費者權益及保護網路數位資訊的發展。

The rapid development of internet network changes the original transaction patterns. It not only provides immediate, interactive and personal ways of buying goods for consumers but also reduces the cost for business. Because of traditional binomial relationship contract of business consumer seems not fit today controversies brought by on-line trade, adjusting legal system has become indispensable policies for worldwide. This paper takes the whole of the digital content as the structure, first discussing the Intangible digital products, and then introducing the regulation of Consumer Protection Statutes in different countries; finally offer several propositions regarding Taiwanese consumer protection policy. The purpose of this paper, which is divided into five chapters, chapter One is introduction which explores the motivations and study methods of this study. Chapter Two explains the definition and types of Intangible digital products, and more introduces the types of Intangible digital products subjects and objects. Chapter Three firstly discusses the evolution process and the legislation feature of National Consumer Protection law and later illustrations to reasons the purposes, conditions and special regulations of the mail-order sales, secondly the questions about Intangible digital products met in the practice by listing the example of Google company vs. Taipei city government and referring to the related opinions of the court and practice. Consequently considers whether the Intangible digital products are uniformly applicable to the part of mail-order sales. Chapter Four explains the related regulations of international organizations and some countries including European Union, American and Japan. Chapter Five is the study conclusions and suggestions, proposing exploration and related suggestions for the dispute types encountered in the practice.
