國家依法實行土地徵收強制取得私人財產,應符合憲法上必要性、最小侵害及比例原則。因此,國家發動土地徵收,必須係為公共利益目的或建設之需要,以強制性手段剝奪人民之私有財產權,基於憲法保障財產權之宗旨,土地所有權人財產其所受特別犧牲,國家應給予適當或合理的補償。 本研究藉由探討2012年9月實施土地徵收市價補償制度以來,對於徵收補償之標準、內容及市價查估基準應如何規範,協議價購市價如何取得及協議價購程序在執行面上的問題,在土地徵收公告階段市價計算方式,藉由徵收補償相關文獻,檢視我國現行制度下產生之徵收補償市價問題。並經由實務運作及法院對於徵收補償市價額爭議案件見解,做一進步的分析、完整性的探討,最後提出個人建議。
The compulsory acquisition of private property by land expropriation by the state according to law should conform to the principle of constitutional necessity, minimum infringement and proportion. Therefore, the land expropriation initiated by the state must be for the purpose of public interests or construction needs, and the private property right of the people must be deprived by compulsory means.
