金融消費者保護法有關金融消費爭議處理機制之研究

摘要


本文研究係2011年12月30日新制定施行的金融消費者保護法,以金融消費爭議處理機制運作所生的相關議題為主。美國次貸風暴後,2007年台灣社會引發一連串金融商品所生的消費者與金融服務業間糾紛;因消費者與金融服務業間的訴訟與締約能力的嚴重差異,致令契約履行上的紛爭,循司法途徑救濟曠日費時,因此催生了我國金融消費者保護法,制定專法設置訴訟外替代紛紛解決機制之體例,並予法制化,以迅速有效處理金融消費爭議。 本研究共分七章節,以研究金融消費者保護法之金融消費爭議處理機制。第一章說明研究動機、研究背景、研究方法及目的,說明研究之進行流程。第二章藉由文獻回顧探討美國次級房貸之形成脈絡,以及對美國及台灣所造成經濟上影響。第三章則敘述我國過去金融消費爭議機制多樣且分散,以致處理程序及作法並不一致,成效亦不相同;並藉由雷曼兄弟連動債之效應,檢示我國過去對金融消費者保護之不足,進而推動本法條催生之源由。第四章則研究英國、新加坡金融消費爭議處理機制及運作,瞭解建立金融保護機制的制定對消費者保護重要性,希期藉他山之石以為攻錯。第五章以金融消費者保護法之內涵進行梳理,包括立法過程,相關提案版本之比較,法條規範對象,保護範圍等,對本法條之重點進行梳理,以了解本法條及金融爭議處理機制運作狀況。第六章以法義解釋為理論依據,析論法條及爭議處理機制運作所可能引發之爭議。第七章則為本研究成果之結論。

The study is based on the Financial Consumer Protection Act which was effective on 30th December 2011, and it is about the issues which was happening when operating the Financial Consumer Dispute Resolution. After the US Subprime Mortgage, there was a series of financial disputes between financial consumers and financial services enterprise. Because there is an extremely difference of litigation between financial consumers and financial services enterprise, there is a dispute of carrying out the contract, Therefore, it is necessary to make a law to protect financial consumers, to effectively handle financial consumer disputes and to promote sound development of financial markets. There are seven chapters in this study. In Chapter 1, it stated the motivation, the general background information, the methodology and the purpose of the study. In Chapter 2, it explored the cause of the US Subprime Mortgage by literature review and what was the effect on the economic in the US and Taiwan. In Chapter 3, it stated the process of dealing with financial disputes in the past in Taiwan was diverse so that the process, the steps, and even the results were not identical, and also it introspected the insufficiency of the protection to financial consumers through the effect brought by the Lehman Brothers Structures note. In Chapter 4, it explored the process of dealing with financial disputes of Financial Ombudsman and Financial Industry Disputes Resolution Centre Ltd to realize the importance of protecting consumers. In Chapter 5, it got deeper understanding about the Financial Consumer Protection Act. In Chapter 6, it showed the possibility of disputes which might happen during the process. In Chapter 7, it stated the results of the study and recommendations for future research.
