我國特種租賃之研究

A Study on the Special Lease in Taiwan

摘要


以房屋、基地、耕地為租賃物之三種租賃,在我國自成一套制度,稱為「特種租賃」。特種租賃雖名為特種,在日常生活卻十分常見,實務上相關爭議亦屢見不鮮。我國租賃之相關規定,多建立在「承租人屬經濟上弱勢」之思想基礎上,因此具有社會化之特性,對於承租人之利益較為保障,而相較於一般租賃,特種租賃此種社會化之表現更為明顯,對於承租人之保護亦更為徹底。惟本文藉由整理、分析、歸納實務之相關判決,發現最高法院在一些案例中,採取目的性限縮之見解,以避免因對承租人之過度保護,而不利社會發展。有鑒於此,本文認為是否應將各類之承租人一概認為其屬經濟上之弱勢而保障其利益,不無疑問,尤其係在以商業經營為目的之租賃中,承租人多屬經濟上強者。因此,本文建議如租金之限制減免、押租金之限制禁止以及承租人之失火責任等現行法中針對經濟上弱勢之承租人之保障,應排除適用於以商業經營為目的之租賃。此外,本文亦試著由民國88年修正之民法債編條文、法條文字之使用、立法者之立法義務、耕地三七五減租條例之存廢等方面,對立法者提出檢討與建議。

The lease of houses, building sites, and farm land forms a particular system called “ special lease” in Taiwan. Although it’s called “special”, it’s common in our daily life. There are a lot of related verdicts in practice. The regulations relevant to lease in Taiwan are based on an opinion that the lessees are weak in economy. As a result, socialization becomes one of the main characters of the regulations relevant to lease in Taiwan, and under these rules, the lessee gets more protection than the lessor. Compared to the ordinary lease, socialization acts much stronger in special lease, and the protection for the lessee is more complete. After sorting, analyzing,and inducting related verdicts, we can find that the Supreme Court limited the application in some cases for purpose in order not to interfere the development of the society. So, it’s doubtful to think all the lessees are weak in economy. For example, lessees with commercial purposes are usually rich. Therefore, it is recommended that the protection for lessees weak in economy, such as the limitation in rent and deposit and the responsibility for fire, should be excluded form leases with commercial purpose. Besides, the conclusion of this article also contains suggestions and reviews to the lawmakers.
