我國律師考試與職前訓練制度之研究

摘要


律師考試於2011年實施新制,在試題題型、命題、閱卷、及格標準方面皆有重大改變,為落實改革精神,有必要檢討其執行狀況。而律師職前訓練自1992年實施迄今已逾20年,職前訓練之重要性向為各界所肯認,然而對於職前訓練實施成效似仍有改進的空間。此外,當新制律師考試及格率提升,及格人數大量增加後,亦出現於考試階段增列錄取人員訓練程序之議,是否妥適,實值探討。故本研究期能透過文獻分析及深度訪談,瞭解律師考試制度變遷及各界對新制考試之評價、探討職前訓練制度之建置背景及運作狀況、分析律師考試及職前訓練制度相關問題,並依據研究結果提出建議意見,作為相關機關改進律師考試及職前訓練制度之參考。 本研究發現律師考試及職前訓練制度因缺乏共識致改革進程緩慢、新制律師考試實施成效尚待觀察、選試政策目的與手段之關聯性不足、職前訓練定位應予釐清、指導律師之付出與回饋顯不相當致難提升指導意願、指導律師與學習律師關係不明、職前訓練制度囿於經費不足難有突破性改革、律師考試尚不宜增列訓練階段,並提出8點建議供參:以執業取向思考考選政策、持續提升試題品質、考試及格標準宜兼顧市場需求及專業品質、基礎訓練可改採學習律師部分自費方式辦理、宜將指導律師與學習律師關係明確定義為執業學習關係、擴大實務訓練處所至企業、機構或團體、提升指導意願、律師考試及職前訓練制度規劃應納入專門職業團體意見。

In 2011, a new system of bar examination with various fundamental changes including question type, grading and standard was taken. Now, it is time to review the status of implementation. New Admittees Training Program of the attorney, started from year 1992, has been used for two decades. New Admittees Training Program has been considered as a significant program, yet it seems that there is still room for improvement. Today, with an increase in pass rate, it is important to know if it is appropriate to add training programs for test-taker in bar examination. Thus, through the use of content analysis methodology and in-depth interviewing, this study tries to identify the histories of the bar examination system and the New Admittees Training Program, and finds out the evaluation and the status-quo of them. This study also analyzes problems that the bar examination system and the New Admittees Training Program occurred, and offers suggestions for related organizations to improve the exam and the training program. This study finds that the slow progress in improvements of the bar examination and the New Admittees Training Program systems due to the lack of general consensus, the doubtful effectiveness of new systems, the inconsistency between the goal and the mean in exam policies, the uncertain role of the New Admittees Training Program, the low willingness on teaching due to the imbalance between what mentor attorneys give and get back, the ambiguous relationship between the mentor attorneys and the interns, the lack of innovation in the New Admittees Training Program due to the low budget and inappropriateness of adding training programs into the examination. To improve it, this study offers eight suggestions: the exam policies should be considered with the market conditions; the quality of exams should be improved; the qualifying standard should be consistent with the market demands, the professional standards; the basic training of attorneys can be at one’s own expense; the relationship between the mentor attorneys and the interns should be well identified; the internship can be extended to private companies, organizations and groups; the willingness of being a mentor attorney should be improved; the improvements of the bar examination and the New Admittees Training Program systems should take expertise’s ideas into consideration.
