摘要

本書首先從西歐的保險制度到東方保險制度的發展，透過時間比對，了解保險制度自財產保險到人身保險發展流程。隨後開始以「臺灣」地區所經歷日治時期日本人統治臺灣時對保險制度之影響，銜接中華民國政府播遷臺灣後保險法的施行，透過相似於保險法第105條、第107條條文的比對，發覺兩個統治政權、不同法律規定所造成的社會影響。
既然研究被保險人之保障，必先以保險契約之重要元素「保險利益」開始談起，國內學說對保險利益定義不同而生許多爭議，本書整理人身保險保險利益之重要問題，如保險利益之功能、何人擁有保險利益、保險利益存在之時點。
隨後開始保險法第105條被保險人同意權的討論，對於被保險人同意權的立法意旨、對照民法同意權的性質，和保險法第105條第1項之同意權行使方式有深入的研究，輔以實務曾出現的問題。在撤銷權部分，首先研究撤銷權立法上的特殊性與歷史定位，並同樣對照民法撤銷權的性質，和保險法第105條第2項之撤銷權行使方式。
針對第107條部分，本書解釋2010年修法前條文內容和批評保險實務運作不當，2010年修正後新法實際為完全解決問題，本書亦說明之。最後，本書以「喪葬費用以定值方式保險」作為本書於保險法第107條之結論。

The book begins with a description of the development of life and property insurance over time from western European insurance law to eastern insurance law. Thereafter, this book looks at the different social impacts arising from the progression of insurance laws under Janpenese rule followed by Nationalist government rule of Taiwan.
The book also seeks to analyze the protections offered by personal insurance, starting with the Insurance Insterest, by answering important insurance questions such as function, beneficiary and effective time.
Lastly, the book ends with discussions on Article 105 and Article 107 of the insurance law focusing on consent, termination and execution.
