在一九八0年代,西方先進國家紛紛創設獨立機關作為政府管制革新之一環,而西方國家創立獨立機關主要是在處理金融、電信及能源等高專業的特殊政策領域。 我國政府亦在此世界潮流之趨勢下,於二000年成立「政府改造委員會」,而其中,政府所推動的行政組織改造中擬設立五個獨立機關,而金管會為其中一個獨立機關。 然而金管會自九十三年七月成立以來,在四年半的運作過程中,爭議風波不斷,如金管會的角色地位不明確、金融會主委更迭頻繁、金融危機處理能理不足、金融政策欠缺周延及執行不力等問題,遭致社會大眾質疑金管會之獨立性及其存在價值。 本文透過Thatcher、Gilardi兩位學者分析獨立機關之五個指標及英、美、德三個國家之金融管制獨立機關在實務運作時所應具有的四個基準點,綜合探討金管會的獨立性,以了解金管會是否符合獨立性條件。
The purpose of this thesis is to study on the Independence of Financial Supervisory Commission(FSC) of Executive Yuan。From 1980s ,the western Countries have created the independent regulatory Agencies(IRAs),Which is one policies of the regulatory reforms,to handle the specific policies,such as the financial policy、telecommunications policy,because the advantage of IRAs is which can insulate from the political influence。 In 2000 Our government plan to create five IRAs ,therefore FSC is one of that。On July 23,2003,the Organic Act of Financial Supervisory Commission has been past。On July 1,2004,the Financial Supervisory Commission has been established。 But the function of the FSC is in half of 4 years not good;it produced many problems。First the independent role of FSC is very vague,though FSC is an independent regulatory agency,FSC is still subordinate to the Executive Yuan。Second the financial and staffing resources of FSC is not really independent;and the party politicization of appointments is very high。Third, in the fact,the Executive Yuan makes the financial policy,though FSC have the making-decision by the Organic Act of Financial Supervisory Commission 。 According to the five independent index by Gilardi 、Thatcher , Our research examine the independence of FSC 。We have the conclusions,that the design of the organization FSC has many faults, And FSC does not match the five independent index by Gilardi 、Thatcher 。
