近年來,中國大陸電影產業蓬勃發展,與國外電影人、電影公司合作愈加頻繁,若發生糾紛,不可避免會產生法律衝突。本研究目的在於解決兩岸視聽著作案件中的法律衝突問題,通過研究兩岸相關文獻,蒐集相關案例,嘗試提出建議。 本文首先探究著作權法律衝突的發生原因,然後聚焦在視聽著作領域,從國際公約出發,比較兩岸視聽著作的法規範,從中發現法律衝突;第四、五章研究各國際公約、國際學術團體對著作權案件的國際裁判管轄權與法律適用問題的規範,比較兩岸相關規範,發現從統一著作權實體法、統一國際私法的角度都不能解決著作權法律衝突問題,唯有透過各國國際私法規範,在個案中予以解決。此外,對於網際網路中著作權案件的國際裁判管轄權與法律適用的特殊問題,難點在於侵權行為地的確定,國際上已有立法例嘗試對此作出規範。第六章選取兩岸視聽著作相關案例各三個,發現中國大陸對待涉外著作權案件,並不足夠重視其中的國際私法問題,而台灣法院判決相對能作出較為完整的論述,值得大陸法院學習。
The film industry developed flourishingly during the recent years in Mainland China. The international cooperation of domestic and foreign filmmakers suggests the inevitable problem of conflict of laws in the related issues. This essay aims to study and resolve problems concerning audiovisual works in Taiwan and Mainland China. The relevant materials and related cases of the two sides are widely reviewed and analyzed before some recommendations are proposed. Six chapters are included to discuss different issues in respective levels. The conflict of laws on copyright is firstly explored and followed by the problems of audiovisual works. From the relevant international copyright conventions to the comparison of the regulations of audiovisual works between Taiwan and Mainland China, the international jurisdiction and applicable law remain as the core issues of discussion. The private international law codifications are of significance in dealing such problems as the place of infringement in cyberspace. Six cases of audiovisual works in Taiwan and Mainland China are selected to observe and compare the judicial practice in the two sides. It is found that the courts of Mainland China did not pay enough attention to the issues of private international law in copyright cases involving foreign elements. The practice and experience of Taiwanese courts are hoped to inspire them from the other side.
