隨著知識經濟的發展,智慧財產權儼然成為企業競爭的利基,近年來生技公司也紛紛設立專利防護網,已形成多層次的專利戰略防衛。根據世界智慧財產權組織(WIPO)統計報導「善加利用專利資訊」,可以縮短研發時間60%,節省研發經費40%。目前有很多研究者運用專利指標,進行專利分析與專利佈局。然而,原有的CHI專利指標能評估公司的技術競爭能力、專利的強度、專利與科學間的連結強度,但無法說明有關設計創新候選技術的選擇與創新的方向。本研究希望透過專利分析,針對生技產業主要的技術群進行分析,結合專利地圖與專利指標以分析產業專利佈局,經專利檢索與引證分析,篩選出可能的設計創新的候選技術,運用統一流程模式(UML)之活動圖,進一步瞭解候選專利的技術脈絡及對應的可能的創新方向,透過TRIZ方法的演化趨勢法則以產生創新概念,此外,本研究以檢查表方式比較原專利與創新概念的專利權,並運用侵權分析,避開原專利的宣告範圍(claims);最後舉一個生技技術的實例,說明創新過程及研究成果。
The development of Intellectual Property Right (IPR) becomes a significant niche for competition among enterprises increasing along with the popularity of knowledge-based economy; lots of enterprises have studied and set the web of IP protection to form a multiple-layer patent strategy defence for years. Referring to statistical reports of WIPO, it could save 60% in research time and 40% in cost, if researchers are good at employing patent information. Now, many researchers study patent analysis and patent portfolio by employing patent indications to realize core competence, patent strength and its scientific link. However, CHI patent indications cannot reveal the candidate of innovation technology and probable manner of invention technology. In this paper, a new scheme for analyzing the biotechnology as well as locating the candidate of innovation technology through the use of patent research, patent citation, patent map and patent indicator, uses activity diagram of UML to expose inventive concept by using evolution theory of TRIZ. Furthermore, a checklist is applied to compare the original patent with candidate of innovative concept by using design around techniques to avoid the infringement claims of existing patents. Finally, an illustrated example is given to demonstrate the research processes and results.
