移民與多元文化：臺灣移民歸化政策的社會基礎

摘要

全球化帶動資本與人的流動，人們因觀光、工作、婚姻、求學等因素遷移，跨國遷移已經是司空見慣之事。各國面對人員的進入給予不同的規範，針對移民制定法規、擬定移民政策。臺灣長期以來就是移民社會，1980年代以後的移民，多數來自中國與東南亞國家，近年從政策、法律的轉變，可以看出臺灣社會對於他們的態度從歧視到接納。本文討論之移民範疇，尚包含專業移民、投資移民等。移民的進入使得臺灣的文化更臻多元，是故在憲法增修條文中，揭櫫臺灣肯認多元文化。在臺灣對於多元文化一詞並不陌生，然我們面對移民時真的落實西方觀點的多元文化主義價值嗎？除此之外，藉由移民現象思考國家與人民之間的關係，再從社會契約論出發，思考法律與國家、社會、人民的關係。本文以官方檔案、文獻資料與訪談對話分析臺灣移民歸化政策，並從這些文獻中，分作政治、經濟、社會地位的面向探討其制定脈絡，找尋根植於臺灣政府制定政策的運作邏輯，即社會基礎的概念，思索歸化法規與社會之間的連結。最後針對多元文化主義在臺灣的脈絡，以及臺灣移民歸化政策做進一步的省思。

In a new era of globalization, immigration has evolved into a prevalent trend in the world. In Taiwan, immigrants from different countries and ethnic groups enrich the diversity of culture. Been recognized widely in Taiwan, the term “multicultural” have been written in the Constitution of Taiwan. Is the understanding of multiculturalism by Taiwanese different from the Western worlds’? With the documentary analysis, I categorized three main principles in Taiwanese immigration naturalization policies: social class, economic position, political factors. The thesis used “social foundations” rather than “social basis” to explain how these principles operate on the immigration policies since foundations contain more concepts of agency. Though the definitions of social foundation and social basis are quite the same, I tend to emphasize the operation of society. In the last chapter, rethink multiculturalism within Taiwan context and conclude immigration policies in Taiwan.
