網路購物標價錯誤法律效果之研究

摘要


自網際網路進入商業應用以來,電子商務所帶來的新觀念、營運模式及行為態樣,透過網路完成交易的情形相當普及,而銷售者於網路上標錯價之情形也經常發生,造成消費者瘋狂下單訂購,但事後網路銷售者卻不願意履行契約,僅提出毫無誠意之補償方案,引發重大的消費爭議。網路標錯價所涉及之相關法律問題究竟為何?又該如何妥善處理?這波不可抵禦的數位趨勢,衝擊著各國過去向以實體概念架構的法律體系,迫使傳統的法律思維必須重新檢討及修正,除了仍要符合實體世界的傳統準則外,也必須因應數位時代各種法律關係的改變而調整。 網路標錯價之相關法律問題,本研究區分為四個層次(一)「銷售者於網站上標價展售商品之行為究竟屬於『要約』或『要約的引誘』?」、(二)「電腦系統自動回覆訂單確認函是否即為『承諾』?」、(三)「若買賣契約已成立,網路銷售者得否主張意思表示錯誤加以撤銷?」、(四)「若買賣契約已成立,且網路銷售者不得主張意思表示錯誤加以撤銷,網路銷售者是否即有依約履行的義務?」加以分析討論。綜合而言,其解決難脫在銷售者與訂購者之間的價值判斷與利益衡量。此類的問題,衝擊各國長期以實體交易開展之傳統法規範,撼動以國家主權為基礎之法律制度,我國是否有因應網路交易環境而制定專法之必要?而目前法院判決、行政機關及學說見解尚未達成共識,單一判決僅具有個案之參考效力,在法院實務未形成共識前,爭議恐難以避免。而根本解決之道,恐係在於銷售者應做好內部控制以避免標價錯誤,而消費者也應節制利用此一標價錯誤而獲取不正的利益。本研究擬藉由此一重要議題,分析我國現行電子商務購物網路標錯價之相關法律問題並針對標價錯誤消費者保護之缺失檢討予提供修法之參考及建議,並藉由外國立法例相關規範或判決,嘗試對國內法院見解進行評析,希望能對於此一問題之瞭解及其解決有所裨益,以確保網路交易的安定性、維護消費者信賴與電子商務市場的競爭力。

Since the Internet has access to business applications, e-commerce brought new ideas, business model and the behavior of state-like. It is quite common to complete the transaction over the network situation and the sellers often occur the wrong price on the network conditions, therefore consumers are crazy with orders, but the network seller is not willing to perform the contract then and only offer the compensation package with no sincerity. Then triggering a major disputes of consumption. What is the relevant legal issues in Network with the wrong price? How to properly deal with? The digital trend is unable to resist and impact on countries to the entity concept-based legal system in the past. It leads to review and revise the traditional legal thinking. In addition to meet the world of traditional norms, but also must respond to the digital age of legal adjust to changes in the relationship. The relevant legal issues in Network with the wrong price is divided into four levels to be discussed: (a) "The act of showing goods with price on the website are the" Offer "or" Invitation to make an Offer "?, ( b) " The confirmation of Auto-reply computer system is belong to " acceptance "?, ( c) Can the network sellers claim dismissal the mistakes to be revoked if the contracts have been established? , (d) Can the network sellers have duties to perform the contracts if the contracts have been been established and the network sellers can not claim dismissal the mistakes to be revoked? To sum up, the solution to the problems are the value judgments and advantages between parties. Such problems, attacking the traditional norms for countries to carry out transactions with entities. Shaking the sovereignty of the state legal system. Whether do we legislate for special law to our online trading environment? The court decisions, administrative authorities and the doctrine of ideas have not yet reached a consensus decision now and a single case of reference only. The dispute is difficult to avoid before the courts reach common consensus. The fundamental solution is that sellers should do a system of internal control to avoid the price mistakes and consumers should also control to take advantage of this price mistakes for illegal benefits. This study analysis of our current e-commerce shopping network with the wrong price of the relevant legal issues, the lack of consumers protection for price mistakes review to amend the law to provide reference and recommendations by this important issue and foreign legislation relevant norms. Trying to comment on court decisions and hoping to help understanding of this problem and its solution to ensure the stability of Internet transactions, maintain consumer trust and e-commerce market’s competitiveness.
