論未成年人與精神障礙者為被保險人所訂立之人壽保險契約─以我國保險法第一百零七條為中心

摘要

保險法第一百零七條，關於限制未成年人、精神障礙者成為死亡保險中被保險人之規定，自保險法制定之初即存在。嗣後，曾於民國八十六年遭刪除，復於民國九十年重新訂於保險法中，然重現後卻問題重重，遂推動於民國九十九年再經修正，惟修正後之保險法第一百零七條，除並未解決既存之問題外，尚產生許多後續之影響，再度引發保險業、保險學者及殘障聯盟團體等批評。

為探究保險法第一百零七條之各種爭端，本文遂自人身保險契約中之保障主體─被保險人出發，檢視其於保險法中之定位以及相關道德危險防止之規範。續自道德危險之防範延伸至保險法第一百零七條，並依歷史研究及過往文獻分析其立法目的、各時期下所討論之問題，另就現行法，探究過往既存及修正後所生之影響。

在分析保險法第一百零七條後，筆者認為最根本之問題，乃為立法者未針對法規主體不同之需求提供不同之防範機制，故最後本文參酌其立法規範、過往不同意見、外國立法例等，綜合提出本條未來可能之修法方向，以期得作為未來修正之參考。

According to the Insurance Act, Article 107, the regulation of the minor and the mentally impaired person are prohibited from enjoying the death benefits , has been formulated since the Insurance Act enter into force . It was deleted in 1997 , shown again in 2001.However, there are lots of problems in the content , so it was amended again in 2010. Not only does the new article couldn’t solve the old problems , but also reduced new influences , therefore criticized by the insurers , insurance scholars , and the organization of disabled person.

In order to investigate the problems of the Article 107 , first , this article will discuss from the main protected subject of the insurance contract ─ the insured , to view the status of the insured and the regulations of preventing the moral hazard. Second , basis on the past literature , article , to realize the purpose of the Article 107 and the discussions in each period.

Finally , lack of different protection for different subjects seems to be the radical problem. For these reasons I am trying to refer the purpose of the Article 107 , past discussions and the foreign legislations , to bring up the possible text for the amendment of the Article 107 in the future.
