各國專利主管機關為解決專利積案困境始尋求國際間專利審查之合作,日前經濟部智慧財產局與美國及日本簽訂的PPH計畫,係推展專利國際合作上重要之突破,當一專利申請案之部分或全部請求項在第一申請局(office of first filing,簡稱OFF)經過實質審查獲准專利後,該案申請人可以藉由提供給第二申請局(office of second filing,簡稱OSF) 相關資料,使OSF得以利用OFF的檢索與審查結果,進而加速該案件的審查。依執行至今之統計數據顯示,PPH計畫有效提升我國專利審查效率,並消化待審案件。 然而,觀察我國執行PPH計畫,似仍存有若干疑義,析述如下: PPH計畫僅限於在國內及國外均有提出專利申請案的申請人方有適用,為保障一般專利申請案件申請人之權益,本文建議我國經濟慧部智財產局應有相關之配套措施,例如限制每個月處理之PPH申請案件數或依據一般專利案件與PPH案件申請數量之比例分配現有的專利審查人員。 鑒於PPH申請案可能影響到一般專利申請案件之審查時程,故本文建議應於專利法第36條增訂第2項「主管機關於必要時得依請求為加速審查,其辦法由主管機關訂之。」作為我國專利申請案加速審查之依據。 另外,針對我國因待審期間較美國及日本長,導致無法充分享受雙邊加速審查效益,本文建議經濟部智慧財產局應以與其他專利主管機關簽訂類似PPH MOTTAINAI計畫為方向作努力,使不受到Paris-PPH要求只有OSF可利用OFF的審查結果申請加速審查之限制。
The Taiwan Intellectual Property Office (TIPO) started the PPH programs with the United States Patent and Trademark Office (USPTO) and the Japan Patent Office (JPO) is an inspirational milestone for patent examination. PPH is a framework for allowing, on request by the applicant, accelerated examination in an OSF (Office of Second Filing) by utilizing the search and examination results of the OFF (Office of First Filing) for the same invention. This cooperative measure helps to avoid duplication of work, so as to shrink patent application backlogs. However, the author found that there are still some doubts to execute PPH program:First, TIPO should limit the treatment of PPH applications per month and distribute examiners in accordance with the number of the general patent case applications and the PPH case applications. Second, the competent authority shall enact regulations for accelerated examination, such as PPH program. Third, because of the long examination pendency at TIPO, search and examination results of applications whose OFF is TIPO could not be provided before the initiation of examination in the OSF. In order to solve this problem, TIPO should sign the program, which is similar to PPH MOTTAINAI.
