摘要
海巡機關職掌事務範圍與內陸之警政署有異曲同工之處，但其地域管轄範圍卻有所不同，文獻多有就內陸地區之錄影監視系統進行探究，但針對港區監視系統的相關探討卻有所闕漏，因此在漁港港區設置錄影監視系統以維護海域海岸之安全同時，有必要就港區監視系統實際上的狀況，瞭解其所面臨的問題，本研究旨在探討港區監視系統所面臨的現況與困境、犯罪預防與偵防效用、成本效益與人權侵犯道德爭議並提出建議。 在研究方法上，本研究採取的是質性研究現象學的研究方法，選定8位在嘉義地區沿海實際接觸港區監視系統安檢所人員為訪談對象，以半結構式的正式訪談方式進行，在資料分析上採取論述分析方法，將訪談所得資料進行整理、分析，並用以支持基本論述，其研究內容顯示嘉義地區港區監視系統所面臨的問題礙於設置的數量和功能不足，在所轄之犯罪熱點（易走私偷渡地點）則無裝設，只就港區內部進行監控，使得港區監視系統的功能大打折扣，在足夠數量和功能的港區監視系統之下，人民對於竊盗案件的侵害較無恐懼感，潛在犯罪者在無法突破時會進行犯罪轉移，在沿海犯罪類型及現有的申調晝面程序下，較無集權主義的氣圍及資料遭不當使用的問題，隱私權侵犯損害程度也較為輕微，而在足夠數量和功能的港區監視系統之才能其發揮的預期的公共效益會大於所付出的成本，也才能符合成本效益原則。 建議在硬體方面能採用現代主動式智慧型錄影監控系統，管線地下化及無線化以降低人為破壞或天然損害，並可藉由結合犯罪預防宣導，增加漁民對港區監視系統滿意度及認同感並藉以融入設計之防衛空間共同監控，港區監視系統的設置理念亦可放置於船舶保全、海難救助、海洋災害救護、岸際糾紛處理、漁業巡護、海洋資源維護及海洋環境保護等其他職掌範圍內之工作層面，以提昇其功能的廣度，建置透明化，標誌一般民眾可辨識之特徵，可以減少人格權侵害的疑慮。

The jurisdiction of affair between Coast Guard Administration and National Police Agency is nearly the same. Only the difference is the jurisdiction of territory. Therefore the implantation of harbor monitoring system for coast guard is to maintain the security of coast. The paper intends to enhance the comprehension of some issues which harbor monitoring system is faced. The study aims to explore the actual situation and predicaments of harbor monitoring system, the effect of crime prevention and investigation of harbor monitoring system, cost-effective dimension, the dispute on human rights violations and morality. The research method engages in qualitative research method and 8 cases are interviewed to reveal their opinions on harbor monitoring system. The findings showed the problems of harbor monitoring system on the coast of Chiayi county are the insufficiency of quantity and limited function. Offenders are more fearless in burglary even harbor monitoring system exists. According to the crime types of coast and the programs in applying for video picture, there are some shortcomings on collective video images, information abuse and invasion of privacy. Harbor monitoring system can produce the effect unless there are sufficient quantity and function. It is suggested that Intelligent Video Surveillance System in hardware and the construction of underground and wireless pipeline can effectively decrease the natural and man-made disaster. It is hoped that the research findings of harbor monitoring system can provide with an insight for further study in the field of crime control.
