摘要 本研究採質性方式,訪談五位在軍事職場上遭受到高階主(官)管性騷擾的受訪者,依加害人的騷擾態樣;反應、申訴及回應;事發後被害人心理反應;期待與建議等四項主題來探討。研究目的在瞭解她們在面臨性騷擾時的感受及因應方式,以及提出反應申訴後國軍單位如何處置。 研究發現受訪者在遭受性騷擾時,多是以消極的方式回應騷擾者,不敢立即反應的原因是礙於對方的「高權」。軍中申訴管道雖然暢通,當受訪者提起申訴後,卻遭單位長官道德勸說、施加壓力,官官相護的態度行徑,讓她們對軍方產生了不信任及怨懟,以及對方懲處過輕而感到不公。另外,軍方心輔制度功能不彰,受訪者未獲得相關支持與輔導。 綜合上述研究發現,研究者提出以下建議: 一、軍法人員回歸專業 二、性別主流化業務分工,提升官兵性別意識 三、接獲通報,立即調查 四、懲處規定應符合比例原則 五、騷擾者進行再教育 六、委外專業,進行輔導 七、廣設監視系統,杜絕死角 關鍵字:軍職人員、性騷擾
Abstract In this study, a qualitative research is used to investigate the following subjects after talking to five interviewers sexually harassed by executives: 1. Appearance of harassment inflictor, 2. Action, appeals and response, 3. Sufferers’ psychic reaction after the harassment, 4. Expectation and suggestions. The objectives of this study are to understand their feelings and response when facing sexual harassment, and how Armed Forces acted after the appeals. This study showed that most of the interviewers took negative action against sexual harassment and did not respond immediately due to inflictors’ “power”. Although there is military's sexual harassment grievance process, the interviewers were morally persuaded and stressed by the managers after the appeals. The situation officials shield one another made them not trust military and have complaint, and they thought it was unfair that the punishment for harassment inflictors were too light. In addition, military personnel's counseling did not work so that the interviewers did not get supports and effective counseling. According to the results above, there are several suggestions proposed: 1.Judges advocates returning to the professional field. 2.Gender mainstreaming division, and to raise gender awareness in the military 3.To investigate immediately once notified 4.The regulation of punishment in compliance with the principle of proportionality 5.The re-education of harassment inflictor 6.Outsourcing to professional companies for counseling 7.To set monitoring systems with no blind spot Key words: Military staff , Sexual harassment
