我國廉政署反貪策略之研究：「政策社群」（policy community）之研究觀點

摘要

臺灣現有主要廉政機關包括檢察機關（含最高法院檢察署特別偵查組）、法務部廉政署及法務部調查局，其中法務部廉政署於2011年7月20日正式成立，是超越過去檢察機關、法務部調查局和政風機構形成的肅貪鐵三角，加入功能完整的廉政署後，將構成新的廉政金字塔體系。主政者多次強調政府戮力肅貪防弊工作的決心，因而廉政署成立時即確立「降低貪瀆犯罪率」、「提升貪瀆定罪率」及「保障人權」為三大目標，據以規劃與推動如何執行新的廉政政策，以喚起全民反貪意識與內化廉潔的社會價值，促進社會誠信與政府廉能。
法務部廉政署成立迄今5年多來，為兼具反貪、防貪及肅貪三大功能的專責廉政機構，相關的廉政政策推動，以反貪與防貪為主、肅貪為輔的工作主軸，而廉政署目前的反貪策略，所扮演的角色、功能及未來工作之挑戰，是否能有效的獲得人民的支持、信任與符合民眾的期待，係本研究聚焦的重點。
法務部呼應主政者及民眾對於廉政目標之殷切期盼，並順應世界的潮流，除檢討目前檢察、調查及政風體系推動廉政的不足之外，更參考國際組織的廉政倡議及《聯合國反腐敗公約》（United Nations Convention against Corruption，簡稱UNCAC）精神，從治標、治本著手整治貪腐，重新建立新的廉政體系，這樣更確立了廉政署的角色與定位。
另外，本研究藉由引介Paul A.Pross針對Graham Allison闡揚政策社群（policy community）的概念及學者宋學文「（3+1）i決策模型」來說明廉政政策決策過程，並將政策社群之四單元就理論面與互動面作其政策過程之分析，來研究廉政署反貪策略現況、未來發展與挑戰，並探討現行廉政署的運作機制及設置之功能性、必要性與區隔性，進而提出有效的防制貪瀆犯罪之目標與策略。
最後透過本研究，提出符合當代價值的廉政署未來思考方向及具體建議。

Taiwan major anti-corruption organizations include prosecutors (including the Supreme Prosecutor Office special investigative group), the Agency Against Corruption (AAC) of Ministry of Justice and the Investigation Bureau of Ministry of Justice（MJIB）. The Department of Justice ICAC formally established on July 20, 2011, this prosecution is beyond the past triangle which formed by Anti-Corruption Ministry of Justice Investigation Bureau and political ethic institution. After adding full-functional Agency Against Corruption, will form a new ICAC pyramid system. Those in power repeatedly emphasized that the government's determination to against corruption, therefore "reducing the corruption crime," "enhancing the corruption conviction rate" and "protecting the human rights" are the three main goals when the establishment of the Department of the Independent Commission Against, to regard as how to plan and promote the implementation of the new integrity policy to arouse people's awareness of anti-corruption and internal incorruptible social values, promote the honesty of society and the integrity of government.
Independent Department of Justice has so far set up more than five years, among rejecting corruption, preventing corruption and investigating corruption are three main functions of specialized integrity agency, to promote policies of integrity related, dedicated into rejecting corruption, preventing corruption and investigating corruption. This research focus on the current anti-corruption strategy of Agency for Integrity, the role it play, the function and challenges of the future work, whether it can effectively get support, trust and correspond with citizens’ expectations.
Ministry of Justice respond to the executers and citizens’ ardent desire of the Independent Commission Against Target, and conform to the trend of the world, in addition to reviewing the lack of current prosecution, investigation and promotion of the integrity of political system, furthermore to consult some international organizations, like ICAC initiatives and "the United Nations Counter corruption Convention "(United Nations Convention against Corruption, called UNCAC) spirit, renovate and re-establish a new integrity system from the symptoms to the root cause of corruption, which is more established the role and position of Agency Against Corruption.
Furthermore,explore the study by introducing Paul A.Pross for Graham Allison extolled policy community concept and academics Soong Hseik-Wen "(3+1) i decision-making model" to explain the policy of Against Corruption’s making process, and analyze policy communities of the four units in the theoretical side and interactive side of its policy process, to research the status of Agency Against Corruption’s anti-corruption strategy, future developments and challenges, and to discuss the functionality, necessity and specialty of Agency Against Corruption’s operation, and then come up with effective crime prevention and control objectives and strategies of the corruption.
Finally, come up with the future direction and specific suggestion which correspond to contemporary values of Agency Against Corruption through this study.
