職務代理是每個機關每個上班日隨時會發生的現象。尤其,2009年8月1日公教人員保險給付增訂育嬰津貼後,需要長期代理的情形劇增。而職務代理制度本是因應人力暫時短缺過渡時期的權宜措施,目前,已成為公部門常態,且長期代理情況日增。 本研究經由檢視我國現行職務代理規定的沿革,和閱讀學者專家研究,以瞭解公部門職務代理制度的法規範;藉由選定北、中、南部四個公部門內人員計十二名為受訪對象,進行深度訪談,整理訪談資料後,從效能性、效率性、公平性、適當性與回應性等五項評估指標,分析代理制度落實的成效。歸納研究結果和發現,據以提出對於職務代理制度法制面和執行面的建議,希冀作為未來職務代理相關法規修正及落實之參考。
In the government organization, job substitution is a usual phenomenon in each working day. Especially, the parental leave allowance for the insured of the government employees was implemented on August 1, 2009. The cases of long-term job substitution are apparently increasing. The system of job substitution is in response to a temporary shortage of staff originally. But, at the present time, it has become a norm in the government organization. This thesis clarifies the content of the system of job substitution in our government by reviewing the history of regulations and by parsing the scholars’ research. Then this study selected twelve interviewees from the northern, central and southern government agencies. After semi-structured interviews, the thesis analyzes interviews from the five indicators to assess the effectiveness, efficiency, equity, appropriateness, and responsiveness to the implementation of job substitution regulations. According to the research results, this thesis attempts to provide recommendations for reference as amending or implementing these regulations.
