國家重大公共工程建設用地取得相關業務執行問題之研究

摘要

公共建設用地之取得為實行公共工程之前提條件，政府基於公權力為公共需要或公益用途，取得土地所有權並給予補償，相關業務有其繁雜與困難性。本研究旨在探討用地取得業務人員執行之困難，並對其實際業務辦理提供建議，以減少因用地取得影響公共建設完工時程，進而提升公共建設辦理之成效。
本研究藉由文獻回顧、資料收集與專家深度訪談，再運用問卷調查的方式，針對公部門辦理用地取得相關業務人員進行調查。從調查結果顯示以徵收方式辦理用地取得比例較協議價購來得高，這主要應是因為徵收具有強制力，而辦理協議價購執行的困難，最主要原因在於無法提供有利的補償條件。從問卷分析結果可知用地取得業務執行時有五項重要的影響因素：(1)與土地所有權人溝通之態度；(2)土地徵收程序之簡化；(3)提高補償價格之訂定；(4)民眾對工程施工有疑慮時的化解方式；(5)被徵收所有權人生存權及工作權保障安置計畫之增訂。為順利推動用地取得之業務，本研究提出四項建議：(1)對於協議價購之補償費，應鼓勵承辦人以彈性協商或由機關訂定較徵收更高之土地補償費標準；(2)訂定合理用地取得作業時程，以避免公共建設完工期限受到影響；(3)給予用地取得業務承辦人員有工作成就感；(4)製作經驗分享案例以供承辦人有交流之機會。

The acquisition of public construction land is a prerequisite for the implementation of public works. The government uses public authority for public needs or charitable purposes to procure land ownership and offer compensation. These related operations have complexities and difficulties. The purpose of this study is to investigate the difficulties for the personnel in implementing the land acquisition as well as provide recommendations on the operation in order to reduce the impact on the completion schedule of public works due to the land acquisition, and thus enhance the effectiveness of operating public constructions. This study conducts a questionnaire survey on the personnel related to the implementation of land acquisition for the public sector. The survey results show that the proportion of levying the land is much higher than purchasing it through negotiation. The main reason is because the levy imposes a binding force; and the difficulty in purchases through negotiation is that it cannot provide favorable compensation. The analysis from the questionnaire results shows that there are five important influence factors in implementing land acquisition: (1) the attitudes when communicating with land owners; (2) simplified land acquisition procedures; (3) stipulating a raise in compensation price; (4) resolutions when people have doubts on the construction works; (5) revising the assurance and resettlement plan for the living and working rights of owners whose land has been levied. In order to successfully promote the operation of land acquisition, this study proposes four recommendations. (1) For the compensation of purchases through negotiation, the operations personnel should be encouraged to adopt flexible negotiations, or the government agencies should set higher standards of land compensation fee than that of levying. (2) Set a reasonable land acquisition schedule in order to avoid the completion time of public works being affected. (3) Give the personnel operating in land acquisition job satisfaction. (4) Produce experience-sharing cases for operations personnel so that they will have opportunities for experience exchanges.
