不鏽鋼材料應用廣泛,台灣地區因氣候潮濕及國人認其有耐用之優點,常選擇作為廚具之主要材料,故普遍率高。但不鏽鋼材料之組成及變化性不同於一般金屬,近來消費爭議及用料不實等負面新聞迭有所聞,究其原因概分為二部份,其一係因某部份不肖廠商刻意使用較不精確文字作為產品成份標示所造成,例如刻意不將不鏽鋼材料正確代號標示確定,導致消費者權益受損。其二係消費者對不鏽鋼材料所認知的資訊為錯誤、不完整或使用方式不當導致締約後產品不如預期,進而要求契約無效或產品瑕疵。 無論係何種情況,皆與資訊揭露義務及雙方資訊地位是否對等有所關聯。故本研究首先收集資料,首先透過文獻說明不鏽鋼材料的成分、類型及防鏽原理,以確立不鏽鋼廚具於材質及使用上的正確認知,次收集目前法律解釋、判例說明國內法律實務界對於廠商揭露義務之見解(消保法及民法),最後以台灣地區人民對於不鏽鋼材料之認知的問卷調查(資料統計)作為研究基礎進行分析,期能為不鏽鋼廚具之資訊揭露界定出一確定的界線,作為產業用於締約前之參考,減少消費爭議。
The stainless steel material is very widely-applied. Due to the humid climate and the confidence of durability of Taiwanese, the stainless steel becomes the priority for system kitchen. However, the components and various properties of stainless steel make it so different from the rest metal material, which causes some negative news about consumer disputes and misunderstandings. Two reasons of such disputes may be concluded. The first is that some dishonest companies intent to use obscure words in products description. For example, hiding the exact model of stainless steel to confuse and take advantage of consumers. The other reason is consumers’ knowledge and information of stainless steel is incomplete. When the stainless products are misused and corroded, consumers become disappointed with the poor quality. And then they think the contract should be invalid or ask for recovery. Both of the circumstances above are related to the Information Disclosure Obligations. This study firstly collects relevant information: reference documentations to introduce the components, types and features of stainless steel to establish the right knowledge of it. Secondly this study explains the courts’ viewpoints of the Information Disclosure Obligations by gathering judges and verdicts (cases about consumers-protecting law and civil law). Finally, basing on the analysis of consumers survey about stainless steel, this study will try to define a clear standard for the Information Disclosure Obligations between sellers and buyers. Also by the standard of stainless system kitchen, it is the expected goal to reduce the consuming disputes before contracting.
