大專校院教職員對著作權保護認知與態度之研究-以某私立大學為例

摘要


時代與科技的演變,網際網路的快速發展,提供豐富多元的資訊供大家分享及利用,卻可能產生資訊使用方式錯誤的情況發生,最常見的問題為侵犯著作權。智慧財產權領域中的著作權法屬於重要的一環,與民眾日常更是最密切相關,亦為最容易產生法律疑問、糾紛與爭訟事件者。現在著作權侵權問題不僅越來越嚴重,而且侵權管道也各式各樣,錯綜複雜。 大專校院校園最有可能發生侵犯著作權事件的地方,教師身為大專校院校園中知識傳播者於執行教學活動時,所利用之教學媒介和教材亦暗含眾多與著作權相關學問;協助學校運作的職員亦可能因執行業務過程中可能著作權相關問題,同時,大專校院校園與教師、學生處在類似環境中,亦可能發生著作權相關問題,可有降低外部變項影響程度。因此,本研究以大專校院教職員族群為研究對象,探討教職員工對著作權認知及態度情形。 研究發現,個案學校教職員工整體對著作權認知部分,呈現較高的理解程度,且對「教學相關著作權」構面的認知最高。其中,以「不同學歷」、「擔任職務」、「任職單位」、「曾研習修過過著作權法」背景變項,呈現較高顯著差異。大專校院教職員工整體對著作權態度部分,呈現較高的正向認同程度,且對「著作權相關概念」構面的認同度最高。「擔任職務」「、任職單位」、「曾研習、修習過著作權法」背景變項,呈現較高顯著差異。整體而言,個案學校教職員工對著作權認知與態度具有正相關。

The evolution of technology and the rapid development of the Internet provide people with a wealth of information for sharing and use, but it may lead to misuse of information, and the most commonly seen issue is copyright infringement. Copyright law plays a key role in the area of intellectual property rights and is closely related to people's everyday lives. Most legal questions, disputes, and litigation arise from it. Nowadays, the copyright infringement issue is getting more serious than ever, and infringement types are various and more complex than everyone may expect. Most copyright infringements occurred on a college or university campus. For teachers who impart knowledge to students in class, the teaching media and materials may involve copyright. For administrative staff who assist in the operation of a college or university, copyright may be involved in their business In other words, copyright plays an important role in a college or university campus. Therefore, this study aims to examine the awareness and attitude of staff towards copyright by taking college or university staff as the target subject. According to the research result, the overall copyright awareness of the staff in the university where the research was conducted is great, especially of the “teaching-related copyright.” Significant differences are discovered in the variables of "different educational background," "job title," "employment unit" and "having studied copyright law." In terms of attitudes towards copyright, university staff showed a higher degree of positive agreement, especially towards the "copyright-related concepts." There was a higher level of significant difference in the variables of "job title," "employment unit," and "having studied copyright law." All in all, a positive correlation between awareness and attitudes towards copyright among the staff of the university where the research was conducted can be observed.
