監獄受刑人對監獄化程度與申訴制度認知、管教接受程度與匿名申訴關係之研究

摘要
本研究者希望藉由探討管理方式、態度、申訴制度及暢通申訴管道，以改善受刑人生活狀況及解決問題需求，減少匿名申訴之發生；另外，也想討論匿名申訴之動機及對匿名申訴探討，採取何種應對方式，消除匿名申訴所造成之負面效應，減少戒護事故之發生，改變國人對監獄負面之看法，同時也希望改變社會大眾對矯正機構刻板印象及不良觀感。 本研究參考國內外有關受刑人在監獄化適應及處遇之相關文獻，兼參酌國內目前法令、學者及看法，從受刑人基本權利觀點探討現行申訴制度；了解國內監獄實務運作中，受刑人申訴制度面臨的問題(監獄化及管理運作對受刑人採行匿名申訴之影響)，再以問卷方式實際分析；受刑人對監獄化程度、申訴制度的認知及對管教人員接受程度與匿名申訴之意向，並運用相關、迴歸做路徑分析其結論如下： 一、監獄化程度對管教人員接受程度為負相關，而管教人員接受程度對匿名申訴意向為 負相關；其中管教人員接受程度成立完全中介效果，亦可透過監獄化程度對管教人 員接受程度預測採取匿名申訴之意向。 二、監獄化程度可預測對申訴制度之認知，成立負相關。 三、監獄化程度對匿名申訴意向成立正相關；申訴制度之認知對採行匿名申訴之意向成 立負相關，但難確立彼此有直接因果關係。

Through the research of the management methods ,of the attitude, of the grievance system and of the way how to make the most use of the grievance machinery, the author hopes to find a way to decrease the choices of using Anonymous grievance machinery, to better the prisoners’ living condition and to find a solution to the problems faced in jail. Moreover ,to erase the negative impact about Anonymous grievance machinery and about the correction system for prisoners, the author discusses both the motives and the prevention of using Anonymous grievance. The research is based on the relative documents about Prisonization ,the laws concerned , and the viewpoints of the scholars all over the world. Discussed form the prisoners’points of view, the research is something about the grievance system and the problems we face in jail when engaged in Anonymous grievance. Through the analysis of the questionaries, the research focuses on Prisonization , Reception about the grievance system, Acceptance of the guards in jail and the motives of using Anonymous grievance machinery. The conclusion comes as follows: 1、We get a negative connection between Prisonization and Acceptance of the guards；between Acceptance of the guards and the motives of using Anonymous grievance machinery. Meanwhile, Acceptance of the guards plays a role as a media. We can also predict the motives of using Anonymous grievance machinery through Prisonization and Acceptance of the guards. 2、We reach a negative connection between Prisonization and Reception about the grievance system. 3、We find a positive connection between Prisonization and the motives of using Anonymous grievance machinery；however, it’s a negative connection between Reception about the grievance system and the motives of using Anonymous grievance machinery. Still, we find it hard to confirm the causal-comparative relationship between both.
