摘要

長期照護需求被確認為一般生存風險後，照護任務現已成為國家福利任務之必要內涵，我國以開辦長照保險來回應國民迫切之照護需求，目前在開辦長照保險之目標下，長期照護保險法及長期照護服務法在台灣已進入草案立法階段。我國欲以長照保險為核心發展的目標下，涉及長照保險法與長照服務法草案之互相配合及內容完善化的問題，從長照保險本身之運作開始，包含長照保險關係主體、保險財務運作與給付機制，到長照服務品質之確保以及照護需求者之保障等議題，其中尤以長照服務品質之確保為貫串兩法的重要問題。
本文在關注長期照護雙法草案內容之外，對於國家於我國長照制度中扮演何種角色亦將進行探討，蓋國家之定位將對長照雙法之內容設計產生連動效應，而台灣對於人民之長照需求，自始即非以國家、而係以民間做為主要服務提供者，相較於國家於各社會保險之過度介入狀況，國家在未來開辦之長照保險制度中應扮演何種角色，即值令人探究。國家為履踐保障人民權益之義務，對長照保險所提供之服務給付負有管理與監督責任，以確保國民均能享受一定品質之照護服務。

In addition to focusing on the content of the draft of the long-term care dual law, this article will also discuss what role the state plays in my country's long-term care system. The positioning of the country will have a linkage effect on the content design of the long-term care dual law, and Taiwan's impact on the people The demand for long-term care is not the state, but the private sector as the main service provider from the beginning. Compared with the state's excessive involvement in various social insurances, what role should the state play in the future long-term care insurance system? The role is worth exploring. In order to fulfill the obligation to protect the rights and interests of the people, the state is responsible for the management and supervision of the service payments provided by long-term care insurance, so as to ensure that all citizens can enjoy a certain quality of care services.
