國家制定法對臺灣宗族制度的影響:韋伯的政治社會學

摘要


台灣「祭祀公業」源自漢人祖先崇拜,數百年來雖歷經清廷、日據、國府等不同統治階段,但此一慎終追遠的民間祭祀傳統,卻一直被保存下來,形成一個台灣民族社會。筆者立基於政治社會學的問題意識上,針對祭祀公業相關的「法律、人與土地」等歷史問題作綜合性的探討。首先,我們以歷史為主軸,並以韋伯的政治社會學觀點,詮釋形式理性的法律與國家制定法,以二元對立式的政治理念模型作為比較,觀察台灣不同統治時期的國家強制力和制定法,對儒家思想文化為中心的宗族組織造成何種影響?台灣祭祀公業宗族組織是否在日據時期的形式理性資本主義衝擊下走向崩解之路?值得探討。

Taiwan's "sacrificial public service" originated from the worship of the ancestors of the Han Chinese. Although it has undergone different periods of rule over the centuries, such as the Qing court, the Japanese government, and the state government, the traditional sacrificial tradition has been preserved and formed a Taiwanese society. Based on the problem consciousness of political sociology, the author makes a comprehensive discussion on historical issues such as "law, man and land", which are related to the sacrifices to the public. First of all, we take the history as the main axis, and to Weber's political sociological point of view, the interpretation of formal rational laws and national enactment of law, binary oppositional political concept model as a comparison, observing Taiwan's different periods of national coercion and The influence of Confucianism on the clan organization which is the center of Confucianism and culture. Does Taiwan's sacrifices to the public and clan organizations fall into the path of disintegration under the impact of formal rational capitalism during the Japanese occupation? Worth exploring.
