大學法律通識課程之推動與挑戰

The Promotion and Challenge of the Courses in Law in the Curriculum of College General Education

摘要


通識教育乃相對於專業教育,目的在於改進、平衡今日大學因為專業分工所造成的教育缺失。法律屬於專業教育,因此,探討大學通識教育傳授法律課程,即可能被認為是一充滿弔詭的題目。但吾人若是從民主法治的觀點,了解國民法律教育的重要性,則不能否認,法律有其專業性的教育目標,亦有其一般通俗的認知需求。既然大學法律通識課程之提供,在於補充國民法律教育之不足,藉以提昇全民法律素養,則其運作方式勢必迥異於傳統法律專業教育,所以對於如何取捨法律課程的重點、教材製作的設計、教授方法的調整及相關資源的配合等問題,都是有待研究的課題。

General Education aims to counterbalance professional specialization and correct the educational problems caused by such specialization in college. It is distinguished from professional education, to which the study of law belongs. Therefore, it may seem paradoxical to explore the teaching of the courses in law in the curriculum of college general education. Yet, if we understand the importance of legal training for citizens-in view of the need to equip them with the knowledge of the legal principles that govern any democratic society, then it cannot be denied that the study of law may aim to provide not only professional discipline but some general knowledge of law. Since the study of law-as part of the curriculum of college general education-seeks to make up for the lack of legal training for citizens and thereby to foster and enhance their legal literacy, its pedagogy must be distinguished from the traditional teaching of law as a professional discipline. Therefore, the questions about the emphasis and focus of such courses in law, about the devising and designing of teaching materials, about the adjustment of teaching to courses objectives, about the supply of relevant resources for such courses-all these questions await further researches sand studies.
