我國全民健康保險法制定與變遷初探

摘要

世界衛生組織(WHO)於1978 年揭示「公元 2000 年時全人類均能享有健康」的綱領後，此一信念成為世界各國追求之目鏢。我國自民國六十九年起，社會與政府揭開為期十餘年對於該法案之討論與立法之過程。嗣後，全民健康保險法草案形式民國八十三年完成立法院三讀審查，制定通過，但旋因立法品質之粗糙，而於該法尚未施行前，立即在立法院進行修法。
自民國八十三年七月十九日立法院三讀制定全民健康保險法後，分別於民國八十三年九月十六日、民國八十八年六月廿二日，以及民國九十年一月四日修法三次。其修法過程、修法環境均有相當程度之差異。本文試圖以全民健康保險法立法及修法為核心，分析該法案之法制變遷，其中包含該法案與憲法及相關法律間的關係，以及該法案在修正時所面對的政治體制與結構之變遷。

The National Health Insurance (NHI) is one of the important social welfare policies in Taiwan. It was legislated by Legislative Yuan on July 19, 1994. But the NHI Act has been amended three times in seven years. Such as Committee Review, Proceed Directly to Second Reading, Second Reading and Third Reading of the Legislative procedure are full-filled of interesting. We may look up the amendment environment and find how different they are.
According to this paper, we may indicate the past amendments are very hard to get consensus in the Legislative Yuan. How to change the condition in the future is a contemporarily serious course in Taiwan.
