摘要

休閒農業經營與管理除農業發展外、尤以土地使用、建築管理、水土保持、環境影響最為密切。因法規適用、解釋立場缺乏統一，常呈法規競合，且休閒農業設施設置欠缺具體規範，造成主管機關受理申請准駁困擾。今以農業發展條例第63條第3項、休閒農業輔導管理辦法及其相關規定為基礎，以農地管理法規為主，參採其他地用、營建法規及技術規範，依循農地利用與管理精神，進行休閒農業設施規範之研究，期能於法源上輔助實質管理效果。休閒農業設施規範以從事休閒農業經營所需農地及其設施為適用範圍，主要結構：l．通則：目的、依據、適用範圍、用語定義、興建原則、另外規定。2．休閒農業設施規劃：選址條件、設施使用強度限制、限制敏感地使用；3．休閒農業設施興建：分項設施興建條件及規模。

The operation and management for leisure farming involve many prerequisites and standards. Among them, agricultural development, land use, building management, water and soil preservation and impacts to the environment are the focuses; in addition, these concerns tend to exhibit the phenomena observed with duplicities of both competitive and cooperative. Since the government's stances in regards to the applicability for laws and regulations as well as the interpretation are varied and non-consolidated; in addition, there is lack of either experience in the establishment for leisure facilities of agriculture or distinct standards in place. Hence, these perplex and puzzle all the proprietors, planners as well as the governing authorities. As of now, using the 3rd item, 63rd article of the agricultural development regulations, counseling and guidance measurements for leisure farm and other relevant rules and standards as the foundation, plus embracing the management laws for the agricultural land as the primary, and referencing and adopting other land use, construction laws and regulations as well as technical standards, abiding by the spirits of agricultural land use and land management, thus, this thesis can proceed to the first phase planning for leisure facilities of agricultural standards. It expects that the actual management effects from the counseling based on the support from laws will be the guidelines.Leisure facilities of agricultural standards adopt the necessary land space for engaging in leisure farm as well as facilities as the scope of application. And its main compositions are:1. General principles Plan the purpose, foundation, scope of application, definitions for the glossaries, establishment principles and other standards.2. The planning for leisure facilities of agriculture Location selection conditions, strength limitation for facility use and limitation for sensitive land use.3. Establishment for leisure facilities of agriculture, etc: Permit application, business accounting for the establishment magnitude and standards for facility establishment.
