安寧緩和醫療條例有關「不施行，以及終止或撤除心肺復甦術」之法律觀點
Natural Death Act Exploring the Law Viewpoint about "Do not Resuscitate (DNR) and Withhold or Withdraw Life-Sustaining Treatment"
摘要
「安寧緩和醫療條例」自八十九年五月立法通過實施後，已於九十一年十一月適度修正，雖然為國內「安寧緩和醫療」以及「不施行，以及終止或撤除心肺復甦術」取得法源依據，但是關於「不施行，以及終止或撤除心肺復甦術」一事，仍舊引起社會界、法律界、以及醫學界的廣泛爭論。尤其，屏東崇愛診所「蔡小妹腦死」事件，引發社會各界廣泛討論，究竟無意識或是意識障礙之無行為能力之未成年人，是否可由其法定代理人或監護人代為決定「不施行，以及終止或撤除心肺復甦術」，頗突顯此問題之重要性。因此，本文擬從憲法及法律之「生存權」、「人性及人格尊嚴」角度，以及「醫學倫理原則」之「自主權」觀點，來探討「不施行，以及終止或撤除心肺復甦術」之適法性，盼能提供醫學界與法學界一個調和的觀點，從而有助於醫師執行其臨床工作。

Since the ”Natural Death Act” was legally issued and executed in May of 1990, it has been appropriately revised in November of 2002. Though ”Hospice and Palliative Care” and ”Do not Resuscitate and Withhold or Withdraw Life-Sustaining Treatment” became lawful in our country, the issue of ”Do not Resuscitate and Withhold or Withdraw Life-Sustaining Treatment” still caused widespread dispute in the fields of society, law and medicine. Especially, with the ”brainstem death of the girl named 'Tsai' ”at Tsung Ai Clinic in Ping Tung it initiated much discussion in all fields of society. Whether the legal representative or guardian of an unconscious or comatose child(who has no ability to act)can decide on his behalf-”Do not Resuscitate and Withhold or Withdraw Life-Sustaining Treatment” or not, makes the importance of this question more remarkable. Therefore, this article will explore the legal issue on ”DNR and Withhold or Withdraw Life-Sustaining Treatment” from the viewpoint of ”Right of Living”, ”Human Nature and Personality Dignity” of constitution, law and ”Sovereignty” of ”Medical Ethics”. Hopefully it can provide the fields of medicine and law a compromised viewpoint and help doctors perform their clinical tasks.
