水土保持治理與管理界面之初步探討

摘要

水土保持之治理與水土保持之管理雖有不同之背景及屬性，但兩者亦存在一定程度之關聯；本文則以統樂開發事業股份有限公司等開發台南縣玉井鄉愛文山地區之事件為例，除針對開發過程中所涉及訴願、行政訴訟及監察院糾正案之內容，分別設定相關議題，並加以解析外，更藉此進而探討水土保持治理與管理之界面，期能促使日後之水土保持治理與管理能相輔相成，亦即，當主管機關對減免土砂災害不遺餘力之同時，亦能有效減少盲點，杜絕不必要之弊端；其所得結論與建議如下：
1.水土保持治理，應儘量減低對周遭環境之衝擊，且其附屬工程，如涉及開發利用行為，亦與水土保持管理有關。
2.水土保持治理之人員，除需具備純熟之技術及卓越之規劃設計能力外，仍應同時加強水土保持管理之相關法令，而能依法行政。
3.土壩雖爲泥岩地區之重要水土保持治理工程，但應避免於「水源水質水量保護區」或特定水土保持區等指定為其工程取土區。
4.農地水土保持與農業使用開挖整地或整坡作業所對應法律效果不同，故應有明確之界面，以免誤用。
5.簡易水土保持申報書之內容雖有相當程度之簡化，但其法律效果上，卻等同於水土保持計畫，故仍應審慎面對。

Although curbing and management of soil and water conservation have different background and attribution, it actually has certain degree of relevant connection. This study will apply the matter of developing process of ”Ai Wen Mountain Area” in Tai Nan Hsien, Taiwan developed by Tung Ler Development Enterprise as a sample to establish and interpret the issues which relates to the contents from appeals, administrative lawsuits and corrective measures from Control Yuan of R.O.C. The study will go further to discuss the interface of curb and management of soil and water conservation in order to complement each other. It can be explained further that the blind spot and unnecessary abuses can be avoided while government organizations work hard to reduce the soil erosion disasters. The conclusions and suggestions are as follows:
1. Curb of soil and water conservation shall reduce the impaction to the surrounding environment. The subsidiary construction such like the utilizing behavior related to development shall also be seen with connection to the management of soil and water conservation.
2. Staffs for curbing soil and water conservation should not only have the proficient skills and designing and planning ability but also should enhance both their knowledge of relevant regulations and capability of application of soil and water conservation management.
3. Earth Dam is an essential construction of soil and water conservation curbing in mudstone area but it shall avoid appointing reserve area of headwater and water quality and quantity and special soil and water conservation district as a construction borrowpit.
4. The interface between soil and water conservation of agricultural lands and earth work and slopeland shaping for agricultural usage shall be precisely due to their difference of legal purpose.
5. A simplified soil and water conservation statement is rather simplified, it should however, be view carefully since its legal power is effective as the soil and water conservation plan.
