摘要


民國92年,我國為符合TRIPS第15條的最低標準及時代潮流需求下,增訂三種新類型的商標種類,即立體商標、單一顏色商標及聲音商標,商標法增訂之後,使我國商標種類更多元化,不再限於平面商標。次年,為使特殊商標在實際運作上更為順暢,經濟部頒佈施行「立體、顏色及聲音商標審查基準」。本文內容包含立體商標的種類、註冊要件及其功能性等議題。本文從大陸、美國、歐洲等國家案例擷取經驗,並希冀我國在未來適用立體商標註冊相關申請案上,能提供更多元化的思考空間,更加從經濟學角度觀察訴訟成本是否符合經濟效益,使社會資源達到有效益的分配。

In 2003, the R.O.C. Trademark Act amended Articles to accord with the minimum standard of TRIPS, like three-dimensional trademark, single color trademark and sound trademark. Next year, the Ministry of Economic Affairs promulgated and enforced ”three-dimensional, color and sound trademark examined basis into the statute.This note tries to introduce the category of three-dimensional trademark, including registration process and functionality. Even the cases happened in the United States and European are few, this note sill discuss the modern world circumstance and economical analysis for conclusion.
