以法律經濟學淺析不動產經紀業者的資訊傳遞之角色-以「凶宅」為例

摘要


不動產交易行為是現行經濟活動中頗為重要項目之一,當若此交易標的物有瑕疵時,會對交易雙方帶來交易糾紛,若此瑕疵為非自然死(亦稱凶宅)時其爭議亦頗大,但此狀況於目前的法律規範中並未有確切規定,不動產經紀業者居於交易行為中的訊息傳遞者時,其所擔負的訊息傳遞程度為何,本文約略以法律經濟學中的訊息傳遞成本對其加以做粗淺探討,在現行的法律層面,不動產經紀業者有調查交易標的物相關資訊之義務與責任,故不動產經紀業者即有將比重大瑕疵的資訊傳遞與告知之法律責任,因而不動產經紀業者可將法律規範等資訊傳遞於相關權利人,另將調查得知資訊告知與相對之交易者,達到不動產經紀業者於法律和經濟效益層面的本質,即是真實資訊的傳遞與告知。

Nowadays, real estate transactions is one of important economic activity in the world. However, if this subject has happened defect in the transaction, then it might bring the dispute between seller and buyer. Especially, if this dispute is non-natural death (below we called haunted house). But, there is no exactly provision to managing this situation in the current law. When the real estate agent dealing in the transaction, and how many responsibilities for them to passing such information to the buyer. In this essay, we would like to discussing about the cost of information pass in the legal economic side. And the responsibility for the real estate agent when they investigate the subject. Therefore, the real estate agent has the responsibility to tell the buyer the related information about haunted house in the real estate transaction. And it would show the benefit of real estate agent in the economic aspect is to transfer and inform the beneficial information in the transaction.
