摘要

近年來，雲端運算已成爲先進國家所重視的新興產業之一。多數政府在雲端運算產業發展中所扮演的角色，是藉由頒布若干指導原則或推動標準，來引導該技術在政府或民間部門應用時之效率性與安全性。然另一方面，雲端運算的應用也造成法規面的若干衝擊，尤其是在隱私與個人資料保護法規範之遵循，相當值得我們重視。本文試圖檢視上述雲端運算發展在政策面與法制面之重要議題，就我國如何整備雲端運算發展之法制政策面的良善環境，提出具體建議。

In recent years, cloud computing has become one of the most emerging industries in advanced countries. In the development of the cloud computing industry, most governments adopt guidance and promote related standards to lead the use of the technology to enhance the efficiency and security within both of the public and private sectors. However, the application of the cloud computing has also brought several legal challenges, especially in the compliance of privacy and personal data protection. The article tries to highlight and examine these vital policy and regulation issues and proposes some suggestions and recommendations in the hope to provide a friendly legal environment for the development of cloud computing industry.
