跨界休眠專利整合活用之可能模式與所涉法制議題研析－以日本新近發展為例

摘要

本文嘗試釐清可以透過「跨界」與「整合」之策略來予以「喚醒」活用之「休眠專利」概念，並介紹日本政府部門公資源投入、尋求跨界整合散在不同權利人手中之技術專利等智慧財產權、以增進其活用之兩個具體案例，藉以做為探討休眠專利跨界整合活用之可能模式的基礎。更進一步，本文從專利群聚的法制面疑義與讓跨界整合休眠專利之主體能發揮多元整合功能之最適法律關係兩個面向著手，點出並初步探討跨界整合休眠專利之活用模式所可能面對的法制議題。最後本文以代結論的方式，從我國政府（以經濟部為例）資助研究發展活動所得研發成果著眼，來探討跨界整合休眠專利之活用模式所必須面對的權利人與權利異質性問題。

This article aims to explore the potential model of intra-sectorial integration of sleeping patents for facilitating their industrial applications. The recent developments in Japan are demonstrated in two case studies: packaging IPRs from various universities in Kanto area, and the first IPR fund ”LSIP” in Japan. Furthermore, this article examines two sets of legal issues concerning intra-sectorial integration of sleeping patents: the anti-competitive issues about packaging patents and the appropriate legal relationships between original owners of sleeping patents, integrators and future licensees of patent packages. Finally, this article analyzes the problem of diversity between original owners of sleeping patents in the context of using patents resulting from Taiwanese government-funded R&D activities, exemplifying in the MOEA regulations.
