Hyperlinks are one of the basic functions of Internet. Internet users can quickly find their digital data on Web by the hyperlink. However, hyperlinks are also related to the liberty of opinion on Internet, which give the source of their speech and provide, in some cases, the proof of their opinion. As a result, hyperlinks' legal status was recently challenged before the Court of Justice of the EU (CJEU) in a case called GS Media. This case gives a perfect occasion to discuss the legal conditions of its use under the article 3 of EU Copyright Directive (2001/29/EC): the Right of communication to the public. Moreover, in this article, several cases of CJEU of the same issue will be analyzed. Last but not least, some remarks about the EU legal use of hyperlinks will be given and also some problems relating to EU standards still need to be resolved in the near future.
