兒少性剝削私密影像案件需求評估與處遇困境之探究－以社工人員為視角

《兒童及少年性剝削防制條例》的更名摒棄「性剝削受害兒少是自主行為」的舊思維，強調兒少不僅為福利的客體，亦為權利的主體；隨著科技發展與多元文化興起，性剝削出現千式百樣的犯罪手法，任何檔案的複製、存取易如反掌，且難以確保可完全清除，讓受害兒少有循環性創傷的風險；因此，站在被害人的角度，有關性剝削私密影像事件發生時，被害人的需求評估及處遇服務，則有探究必要，本研究以質性研究方法，透過解構來自北、中、南、離島等7位不同縣市社工之工作經歷，分析性剝削私密影像事件的受害原因，並探討社會於性剝削私密影像的「受害」意識，了解該類型案件的需求，進而探詢受訪者可能遭遇的困境及服務策略。研究結論發現，需求評估上除了兒少各方面需求外，受害兒少之家庭及照顧者亦有被同理與支持的需求；此外，性剝削防制專業人員需持續精進相關知能，避免疏忽兒少及其家庭的權利，社會大環境亦有提升對於性剝削認知之需求，以提升社會系統中各項保護因子，同時透過研究結果瞭解執行處遇期間遭遇到的處遇困境及因應策略，並具體從處遇服務、宣導及預防、法律與制度等3層面提出建議，期能提升性剝削私密影像事件的處遇品質及預防之效。

The change of the legal title of the Child and Youth Sexual Exploitation Prevention Act has abandoned the old thinking that "children and youth victims of sexual exploitation are autonomous acts". It emphasizes that children and adolescents are not only objects of welfare, but also subjects of rights. With the development of science and technology and the rise of multiculturalism, sexual exploitation has emerged with changing criminal methods. Any file can be easily copied and accessed, and difficult to erase, exposing child and youth victims to a circular risk of trauma. Therefore, from the perspective of the victim, it is necessary to explore the needs assessment and treatment of the victim when the private video case of sexual exploitation occurs. This study uses a qualitative research method to analyze the causes of victims of the leakage of private images of sexual exploitation through the work experiences of social workers in 7 different counties and cities in the northern, central, southern, and outlying islands, and explores the society's response about "victim" awareness to the leak of private images of sexual exploitation. This article also wants to understand the needs of victims of sexual exploitation, and then explore the difficulties that respondents may encounter and service strategies. The conclusion of the study found that in addition to the various needs of children and adolescents in needs assessment, the families and caregivers of victimized children and adolescents also have the need for support. In addition, preventers of sexual exploitation also need to continue to improve their knowledge to avoid neglecting the rights of children, adolescents and their families. The social environment also has the need to improve the awareness of sexual exploitation in order to enhance various protective factors in the social system. At the same time, through the research results, we can understand the difficulties encountered during the implementation and the coping strategies. This article will also specifically put forward suggestions from three aspects: treatment service, publicity and prevention, law and system, in order to improve the treatment quality and prevention effect of sexual exploitation private image leakage cases.
