摘要

本文係針對高等教育階段宗教興學之類型及現況加以分析，同時探討其所涉及之憲法上永本權利與相關之憲法問題。其次，並對我國現行法制下，教育森本法與私立學校法相關規定對於宗教興學所產生的規範與限制加以討論。最後並就這些規定所產生的法律問題與未來修訂法規時攤須考量之法律問題提出本文之建議。

This article analyzes the pattern and the situation of higher education institutions established by religious organizations in Taiwan and discusses the constitutional problems with the fundamental human rights concerning these institutions in the Constitution of R. 0. C. Furthermore, this article aims to interpret the norms and limits of these institutions regulated by the Fundamental Law of Education and the Law of Private School. Finally, some suggestions will be offered about the legal issues in terms of modifying the laws.
