摘要

本文分別針對電子化民主下的電子投票與電子參與，就所涉及的法制議題，提出看法。在電子參與方面，對於電子公共論壇，法制規劃的重點應以明訂政府機關設置論壇之義務、論壇規約內容之限制、論壇咨商討論結果的後續法律效力、保障人民隱私及降低人民排拒心態為主。其次，以論壇規約配合管理者執行論壇管理措施，較為妥當。至於電子民意信箱，應明定政府機關得不受理請願或陳情之要件。在電子投票方面，應先確立公領域電子投票應用所應遵循的原則，再進行各種電子投票技術應用於公領域投票的可行性分析，確立符合投票原則的應用技術規格。

This paper discusses some legal issues on e-voting and e-participation. As to applying electronic public forum to enhance e-participation, we propose to make it into law that government is required to establish electronic public forum, prepare forum rules, and protect participators' privacy. This law should also deal with how forum discussion is connected to government decision process. Besides, the forum rules must be seriously followed. As to government setting up electronic-mailbox for petition, in order to reduce abuse and properly save administration resources, some legal requirements must be set on people's petition. On e-voting, several basic principles are presented. All e-voting technology must address these requirements.
