Abstracts

主給付以外其他義務違反法定契約解除之要件，應區別義務違反所侵害之法益為給付利益或完整利益。前者，契約解除之基本思想為契約目的不達，故而，若因債務人根本不履行義務致侵害給付利益，應直接適用民法法定解除之一般規定，但在第254條之情形，義務若僅為輕微部分，義務違反並不至於使契約目的不達，仍不得解除契約。後者，契約解消之基本思想為信賴關係破壞無法期待繼續維持契約。

Parallel abstracts

If the violation of accessory obligations results in the damage of the expectation interests, the general principles of the termination of contract should apply. In case of the violations of the duty to respect each other's rights and legal interests, the aggrieved party may terminate the contract if he can no longer reasonably be expected to accept performance.
