A Discussion on the Existing Related Law of City Park

摘要

隨著都市及經濟型態的改變，群眾對都市公園的需求日益殷切，但無論是公國的規劃、開發、相關設施及維護管理等，都無法滿足群眾的休閒需求並發揮其在都市中所扮演的角色。本研究是從現行都市公園相關法令規章的回顧及整理，以公園計畫體系及其相關事業的運作及執行爲主要課題，再對照都市公園的現況，結果在現行法令執行體系及運作上有三項困難值得注意：(1)缺乏更高階層的管理機關，(2)公園用地不足，(3)多目標使用的缺失。最後是建議擬定都市公園的長期發展計畫及加強公園管理單位的組織體制二項議題，來突破都市公園現有的爭議及瓶頸，使公園在未來都市中能夠有效的發揮其功能。

Following the rapid change of the city and economic environment, the city parks are in great demand by the public. However, no matter the park's planning, development, related facilities, maintenance or management are all unable to satisfy the public's leisure demand and also unable to play a good role in the city. This research makes the retrospect and arrangement on the existing related laws of the city park, using the park planning system and execution as the major issues which will be then compared to the current situation of the city park. As a result, in the execution system of the current laws, there are three difficulties to be noted: (i) No high level organization in charge of it, (ii) Insufficient lands for park use, (iii) Disadvantage from multipurpose using. Finally, to draw up the long-term developing plan of the city park and to strengthen the organization system of the unit in charge of the park are two issures to be suggested for breaking through the existing disputes and bottlenecks of the city park and enabling the park to develop its utmost function in city in the future.
