Safety Management and Legal Liability for Forest Recreation Areas

摘要

近二十年來國民戶外旅遊風氣日幟，遊客量逐年增加，加上特殊區位關係使得森林遊樂區面臨沉重的遊憩安全壓力。十多年來國家賠償法的施行與近年來的消費者保護法之制定，使得遊憩安全管理工作愈走向法制化與社會保障制度。本文首先闡述遊憩安全概念，並提出森林遊樂區潛在危險因子調查與評估架構。其次，就森林遊樂區之經營管理工作可能涉及侵害人民之自由及權利而被請求國家賠償時，討論構成賠償的條件，並且引介美國戶外遊憩的法律責任概念。最後，結論與政策性及實務性的建議亦被提出。

More people are participating in various outdoor recreation activities than ever before. Because of remote location and inceasing recreation use, forest recreation areas are confronting with the issues of outdoor recreation safety. In the last ten years the exercise of tort reimbursement act and legislation of consumer protection act have been put the recreation management efforts into a more legal and social security settings. First, this article addressed the concept of recreation safety, and then proposed a schema for the investigation and assessment of hazards in the forest recreation areas. Furthermore, recognizing societal tendency to bring legal action for injuries suffered in forest recreation areas, the article discussed the conditions of tort claims and illustrated the legal liability in wilderness area from U.S. Finally, conclusion and suggestion for policy and practional are also offered.
