摘要

在拉丁美洲教授中國法是一項新生的事物，但在西方缺少能讓西方人真正理解東方法律和文化之基本原理的中國法教學資料。目前權力格局正在由西向東發生移轉，但西方主流思想遵從的是相對主義。如果東、西方之間不能加以改變，找到溝通彼此的共識基礎，那麼將使我們這個世界陷入嚴峻的危機之中。儒家思想與從中世紀薩拉曼卡學派發展而來的「真正的自然法」在很多方面具有相似性，因此「真正的自然法」可以成為這樣的溝通基礎。「真正的自然法」不同於現代人所熟知的自然法。格勞秀斯和普芬道夫等剝離了「真正的自然法」中的客觀基礎，並將其僅僅依附於因時代或文化的不同而發生改變的人類「理性」，從而使自然法走向了相對主義。「真正的自然法」也是目前拉丁美洲主流大學法學院教授中國法的基本方法。

Teaching Chinese laws in Latin America is something new, while in the West there were no reference materials available about teaching Chinese laws for western people to understand the fundamentals of the legal system and how it works. Nowadays there is a power shift from the West to the East，but the main stream of Western thought follows relativism. If the East and West do not change and find real common ground to understand each other, they will lead the world into a deeper crisis. Because there are similarities between the ＂real natural law＂, originated from School of Salamanca in the Middle Ages, and the Confucianism, the ＂real nature law＂ can be the common ground for understanding between West and East. The real nature law is different from nowadays what is overwhelmingly called ＂natural law＂. Grotius and Pufendorf detached real natural law from objective foundations, attached natural law only to human ＂reason＂ which can change with time and culture, and thus lead nature law to relativism. The real nature law is the fundamental approach to teaching Chinese laws in main law schools of Latin America.
