由《管子》觀齊法家的法治特徵

摘要

本文旨在闡述齊法家法治之特殊性。地域文化與思想之形成休戚相關，本文先述齊地的文化性格，再梳理齊地形成之法家「法」觀念內涵，終將齊法與三晉法家之對比，突顯齊法家之法治特徵。齊法家之特色在於重法尊君，但不輕教化；強調刑罰，但更重施罰之公正；重視君臣尊卑，但不強調彼此心計，更重君臣關係之和與同，期望以法治國，舉國同心同德而為一體。齊法家受齊地文化性格之影響，造就了溫和不過激的法家型態。

The purpose of this dissertation is to elaborate rule by law on Qi region Legalists. The thoughts are closely related reginal culture. The research questions are: (1) What were the culture characteristics on the Qi region? (2) How about Qi region Legalists explained about ＂Fa＂ thoughts on Guan-tzu? (3) Compare SanJin Legalists with Qi Legalists to present how special are Qi Legalists? This study are proposed three point to show the special form Legalists: 1. legal outranked monarchy 2. enforcing the law was tolerant 3. liege relationship is harmonious.
