地方政府山坡地開發審查作業之改進方式

摘要

山坡地由於環境複雜的特殊性，在土地利用規劃與管理上極具挑戰性，一方面，山坡地係環境敏感及稀有資源之蘊藏地區，不當的開發利用極易傷害環境本身；另一方面，隨著經濟成長與都市發展，對都市土地的需求（如住宅用地、工業用地、娛樂設施）愈為迫切，都市向其周圍地區擴張為不可避免之趨勢，山坡地即成為主要的開發利用對象。就土地開發控制而言，山坡地是目前臺灣實施開發許可制最具體的對象，也是最具實施經驗的地區。然而，現行的山坡地開發審查作業，尤其是縣市政府的作業卻一再爲人所詬病。如何改進現行的山城地關發審查制度，以提昇開發審查之作業品質乃一重要課題。本文之目的在於檢討目前縣市政府層次有關山坡地開發審查之作業方式，並研提改進之辦法供未來進一步實施開發許可制之參考。

Due to the specialty of environmental complexity, land use planning and management of hillside area is a challenging task to planners. On the one hand, hillside area is environmental senstive, any inappropriate development could damage itself. On the other hand, outward expansion is an inavoidable trend of urban development, hillside area becomes the major target of land development in Taiwan. From the viewpoint of land development control, hillside area is the most experienced area of the exercise of development permit system in Taiwan, however, the reviewing process has often been criticized, especially at the local governments. It is a critical task to improve the existing hillside land development reviewing process to gain better effectiveness. The purpose of this paper is to investigate the current reviewing system of hillside land development at local governments, and to propose improvement approaches for the future promotion of development permit system.
