博奕事業管制制度之研究

摘要

開放特區賭博議題，近已為眾所矚目之事，甚至即將成為我國的政府正式議程，規劃相關配套措施，但衡諸我國國內過去的文獻顯示，多數研究仍屬於政策可行性、區位條件、或開放特區賭博的利弊得失，鮮少探究未來若開放特區合法賭博後，相關的政策設計、管制措施，以及主管機關的組織與權責等議題。
本文的目的，即在於從管制制度與政策的角度，分析未來的管制措施，包括：似宜採取高度的管制措施；並應賦予主管機關強有力的調查權及裁罰權，以保護博奕事業正常且合法發展；以「適當競爭，加強管理」的原則，設計博奕事業管制制度。

The issue of legalized gambling is getting more and more attention in Taiwan. In fact, legalized gambling maybe become the formal agenda of Taiwan government. With regret, the studies of gambling or gaming in Taiwan are still concerned the policy feasibility. There are few studies about the gaming control or regulatory. We will briefly discuss the content of gaming control, and make some suggestions for government in Taiwan as follows:
●To format intense regulatory policies to get rid of people’s worry toward gambling.
●To authorize a new organization to implementing gaming control policies.
●The goal of gaming control should be “monopolized competition, strictly manage”.
