法學研究方法之述略

摘要

本文就學者間已經提出之研究方法做概略性之歸類工作，大體而言，分為傳統之法律哲學研究法與科學的研究方法兩大類。同時，本文也提到法官造法之限制以及法最高理念的實現。

This paper first introduces and then generalizes the methods used in the study of law by legal scholars. Generally speaking, legal methods can be grouped into two main categories-the traditional approaches of the philosophy of law and scientific approaches of law. Moreover, this paper also discusses two issues: the restraints of judicial law-making, and the realization of the ultimate ideas of law.
