我國新舊「國民體育法」比較分析

摘要

國民體育法是我國體育的根本大法，是推動國家體育運動建設的重要準據，我國政府全面配合「行政程序法」民國九十一年一月一日起實施，體育行政事務工作依法行政自不例外。總統於八十九年十二月二十日以華總一義字第八九○○三○一○七○號令公布。「國民體育法」原條文共十五條，此次修正公布之條文，計有二十二條，是國民體育法五次修正案中，修正幅度最大的一次，此次修改「國民體育法」，深具時代意義，影響我國體育運動發展甚鉅。
本文以新修正公布的國民體育法與舊法作比較，藉以提供體育界瞭解其新舊法差異處，並可自九十年一月起事前因應，體育工作將面臨依法行政之所帶來的衝擊，順利邁進體育法治社會。

The National Sports Act is the basic law regulating Taiwan’s sports affairs. It serves as important criteria by which Taiwan pushes forward the national sports development. The government of Taiwan will begin to enforce the Administrative Procedural Act comprehensively on January 1, 2001. Government agencies will be required to carry out their affairs in compliance with the Administrative Procedural Act. There is undoubtedly no exception with the implementation of national sports affairs. To this end, the President already issued an Order No. 8900301070 dated December 20, 2000, to promulgate a new version of the National Sports Act. The new version has a total of 22 articles while the original version contains only 15 articles. The amendment to the National Sports Act is of great significance though since it will mark a milestone for Taiwan’s sports development.
This paper is to compare the old version of the National Sports Act and the version newly promulgated by the President. The comparison is expected to help the sports sector in Taiwan to see the differences between the two versions so that proper action can be taken beforehand since potential impact is foreseen while sports affairs will have to be handled in accordance with the Administrative Procedural Act starting January of next year. Through such comparison, we hope that Taiwan’s sports development can smoothly march toward a law-ruled society.
