摘要

本研究的目的在於比較不同版本的牙科臨床治療指引的差異，並探討該差異所可能引發的法律問題；進一步探討究竟一個標準的臨床治療指引應具備何種要件，以做為未來修正並減少不同版本臨床治療指引的衝突。研究方法則是比較中華牙醫學會、中華民國牙醫師公會全國聯合會及中央健康保險局所制定的牙科臨床治療指引中的差異所在，並以文獻回顧方式比較我國法律學界及實務界如何採用不同版本的臨床治療指引。研究結果顯示，公會版及健保局版臨床治療指引的某些部份，並無合理的研究文獻支持，可能導致潛在的法律問題。惟如何進一步制定一個國內標準臨床治療指引，需加強本土實證牙醫學研究為其基礎。

The purpose of this study is to compare different versions of dental clinical practice guidelines and explore the possible legal problems caused by the differences, and furthermore probe into the fundamental standards of clinical practice guidelines so as to provide references for future revision and minimizing conflicts of various versions. The research method is by comparing the differences of the dental clinical practice guidelines from Association for Dental Sciences of the Republic of China, Taiwan Dental Association and Bureau of National Health Insurance; and through literature reviews, different versions of clinical practice guidelines adopted by academia and practices in law. The research results showed that some portions of the versions of Association for Dental Sciences of the Republic of China and Bureau of National Health Insurance are not consistent with the reasonable studies and may result in potential legal problems. As to further guidance on establishing national standard clinical practice guidelines, domestic evidence-based dental researches need to be improved.
