機制與變遷:中國信訪制度的存廢爭議

Mechanism and Transition: The Argument of the Existence of the Complaint Letters and Calls System in China

摘要


「信訪」是「人民來信」和「人民來訪」的簡稱。信訪制度作為一項具有中國特色的政治參與和權利救濟制度,雖然在計畫經濟時代發揮作用,但由於信訪制度存在諸多缺陷,無法適應轉型期中國的市場經濟環境,客觀上造成國家政治認同性的流失。面對信訪制度的困境,有人主張賦予信訪部門職權並強化信訪制度;但反對者認為長痛不如短痛,建議大幅削弱,乃至於撤銷信訪制度。本文試圖以衝突功能主義者科塞的社會安全閥理論,檢視當前中國大陸信訪制度的存廢論爭及解決信訪悖論之道。

Complaint Letters and Calls System in China has been served as a kind of political participation and an administrative remedy. Although this system functioned well in the planned-economic era, it contains certain shortcomings, and it cannot fit in today's market economy system. It makes people loosen their political identity with the country. Faced by the difficulties caused by this system, some suggest to strengthen it's functions, while others suggest to limit them, even to cease their existence. This article tries to apply Lewis A. Coser's Social Safety Valve Theory to the analysis of Complaint Letters and Calls System-should the system continue to exist?
