中國台商在東協經濟共同體中投資保護機制之芻議

The Protection of Taiwanese Entrepreneur in China-ASEAN Free Trade Area

摘要

中國於2010年元月與東南亞國協成立自由貿易區後，近年來經濟成長快速，已成為東南亞國協第一大貿易夥伴。在原本的台商保護法制上，中國雖已分別制定《臺灣同胞投資保護法實施條例》等規定，但在中國－東南亞國協自貿區乃至於2015年底剛成立的共同體中，目前尚欠缺獨立針對台商保護的專法，在保護規範密度有所欠缺。本研究謹提出法制芻議，期能在這個日益茁壯的地區，給予台商有效及適度保護，裨益兩岸及東南亞地區經貿關係。

China-ASEAN Free Trade Area is established in 2010. In this region, China has become the largest trading partner of ASEAN in recent years. The Taiwan enterprises protection mechanism is effective in mainland China, but there exits the necessities in South-East Asia region. This study first analyzes how China- ASEAN Free Trade Area affects the mainland China and Taiwan, and concludes with recommendation of the rule of law. Also, this paper reminds the Chinese authorities should pay attention to the rights and interests of Taiwan enterprises, and gives them suitable effective and appropriate protection in this increasingly robust region.
