摘要
本文係對土地使用管制法律爲全面的研究，可分爲八大部份，第一部份爲引言，第二部份探討政府管制土地使用的必要性，以明瞭公權力爲何必須介入土地開發利用，並說明政府管制土地使用所包括的範圍；第三部份研究土地使用管制的法律基礎，以說明政府干涉土地利用的合法性，並就土地使用管制法律的違憲與否加以審查，以明土地使用管制法律亦受憲法的限制，而有違憲的可能；第四部份臚列土地使用分區管制(Zoning)有關法律名稱及其內容，作爲研究現行土地使用分區妥當性和有效性的基礎；第五部份介紹文化古蹟保護法律對於土地使用的限制，並凸顯此種法律對土地使用的影響；第六部份敘述環境保護法律對於土地使用的限制，以彰顯環境權的提倡對於土地使用的影響；第七部份檢討台灣現行土地使用管制法律，並提出具體建議；第八部份總結全文，提出本文的結論。

This thesis is an overall research of land use control laws. It includes eight parts. Part one is an introduction. Part two explores the necessity and scope of governmental intervention to land use. Part three researches the legal bases for land use controls, and explores the constitutionality of land use control laws. Part four exemplfies zoning laws and their contents. Part five introduces historical preservation laws and their impact to land use. Part six narrates and appraises environmental land use controls. Part seven reviews curent laws concerned and submits a proposal to amend the land use control laws in Taiwan. Part eight is the conclusion.
