Abstracts

吾人營社會生活，不能過著毫無秩序的社會生活，故須制定成文法，以為最低之秩序。法律規範對於應規定事項，或由於立法者之疏忽未預見；或情事變吏，致就某一法律事實未設規定時，審判官如何探究規範目的，補充法律漏洞，掌握法律之一般妥當性，實為一值得探究之問題。為使吾人更其客觀的態度及方法，本文擬以模糊聚類分析方法，檢證法律漏洞補充之妥通性，以符社會一般人之期待及利貫徹實踐法律之規範目的。

Parallel abstracts

Ubi societas, ibi ius. This paper attempts to link fuzzy theory with remedying the gaps in law in applying the rules. It proposes tentative solutions to the fuzzy phenomena that often exist in the process of applying the law with the aim to make the law remedy be more objective. The basic concept of the gaps in law and a brief introduction the fuzzy cluster analysis are presented first. Continuously, the system's structural model constructed according to the fuzzy cluster analysis is proposed. Finally, the case study is illustrated.
